Yes,third party fighters have been a thing since Brawl.

And Banjo-Kazooie was developed by RareWare, which is owned by Microsoft.

Uh... You do realize that Snake, Cloud, Joker, Sonic, Banjo-Kazooie, Hero, and others aren't owned by Nintendo, but they're in... Right?
